These Terms and Conditions ("Terms") govern your use of the website located at hemetmasonry.com (the "Site") and your engagement with Hemet Masonry ("Company," "we," "us," or "our") for masonry and related services. By accessing the Site or contacting us for services, you agree to these Terms. If you do not agree, please do not use the Site or engage our services.
By using the Site, submitting a contact or estimate request, or entering into a service agreement with Hemet Masonry, you confirm that you are at least 18 years old and have the legal authority to agree to these Terms on behalf of yourself or any entity you represent. We may update these Terms from time to time. Continued use of the Site or our services after changes are posted means you accept the updated Terms.
Hemet Masonry provides masonry and related contractor services, including but not limited to foundation repair, chimney repair, tuckpointing, brick and stone work, retaining walls, driveway pavers, walkways, and outdoor masonry. Services are provided to residential and commercial property owners in the Hemet, CA area and surrounding cities. The Site is informational and is used to connect prospective customers with our team. No contract for services is formed by visiting the Site alone.
Any estimate provided by Hemet Masonry - whether by phone, email, or in person - is based on information available at the time of assessment. Estimates are not binding contracts. A final written quote will be provided before work begins.
Prices quoted are subject to change if the scope of work changes after the estimate is provided, if site conditions differ from what was visible at the time of assessment, or if material costs change between the estimate date and the scheduled work date. Any changes to scope or price will be communicated to you in writing before additional work proceeds.
Estimates are provided at no charge and with no obligation to proceed.
Once you accept a written quote and a work date is scheduled, we ask for at least 48 hours notice if you need to cancel or reschedule. Cancellations with less than 48 hours notice may result in a rescheduling fee, particularly if materials have already been ordered for your job.
Hemet Masonry reserves the right to reschedule work due to unsafe weather conditions, material availability issues, or circumstances beyond our control. We will notify you as soon as possible and work with you to find the earliest available alternative date.
Payment terms will be specified in your written service agreement. Unless otherwise agreed in writing, a deposit may be required before work begins on larger jobs, with the remaining balance due upon completion. Payment is due on the date specified in your agreement.
Accepted payment methods will be communicated at the time of agreement. We do not collect payment through this website.
Overdue balances may be subject to a late fee of 1.5 percent per month, or the maximum amount permitted by California law, whichever is lower.Hemet Masonry reserves the right to pursue collection of unpaid balances through lawful means, including referral to a collection agency or filing in small claims court.
Specific warranty terms for completed work will be provided in your written service agreement. In general, Hemet Masonry warrants that work will be performed in a workmanlike manner consistent with industry standards for masonry in California.
Warranties do not cover damage caused by events outside our control, including but not limited to earthquakes, flooding, acts of nature, improper use, or alterations made to completed work by others. Warranty claims must be submitted in writing to the contact information below within the warranty period stated in your service agreement.
Materials supplied by manufacturers carry their own separate warranties. We will assist you in connecting with a manufacturer for material warranty claims, but we are not responsible for manufacturer warranty fulfillment.
To the fullest extent permitted by California law, Hemet Masonry and its employees, subcontractors, and agents will not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to the use of our services or this Site, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from services provided under a written agreement will not exceed the total amount paid by you for the specific work giving rise to the claim.
The Site and its content are provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content on the Site. We do not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components. Use of the Site is at your own risk.
If a dispute arises between you and Hemet Masonry relating to services or these Terms, the parties agree to first attempt to resolve the matter informally by contacting us directly at the information provided below. We will make a good-faith effort to address your concern within 10 business days.
If informal resolution is not possible, any dispute will be resolved through binding arbitration in Riverside County, California, under the rules of a mutually agreed-upon arbitration provider, unless the claim qualifies for California small claims court, in which case either party may bring the claim there. You waive any right to a jury trial for claims covered by this section.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not covered by the arbitration clause above will be brought exclusively in the state or federal courts located in Riverside County, California.
All content on the Site - including text, images, logos, and design - is owned by or licensed to Hemet Masonry and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or use any Site content for commercial purposes without our written permission. Brief excerpts may be shared with proper attribution.
We may revise these Terms at any time by posting the updated version on this page with a new effective date. Your continued use of the Site or our services after the updated Terms are posted constitutes your acceptance of the changes. If you have an active service agreement with us, the Terms in effect at the time of that agreement govern it unless we mutually agree in writing to different terms.
